The Contract
The contract shall be between Prospect and the Client. ‘Prospect’ means Prospect Music and Art Tours Limited. ‘The Client’ means every person whose name appears on the
Booking Form.
The person signing the Booking Form warrants that he or she has the authority of all the other named persons to contract on their behalf.
It is agreed that all relations between Prospect and the client shall be governed by and subject to the conditions. No person other than a Director of Prospect has authority to waive, vary or modify these Conditions and no such waiver, variation or modification shall be of any effect unless in writing.
No contract shall exist until a written confirmation of the booking has been issued by Prospect to the client.
Any monies paid by you to a Travel Agent are held by the Agent on our behalf.
On tours of 5 days or more in Europe, and on all tours outside Europe, persons over the age of 75 will be required to submit written confirmation from a medical doctor that they are fit to travel.
Persons with physical disabilities or other handicaps requiring special treatment or assistance, including persons confined to wheelchairs, must advise Prospect in writing of the nature of such conditions at the time of requesting reservations.
Prospect reserves the right to refuse to carry anyone who has failed to notify them of such disabilities or need for assistance or who in Prospect’s opinion is unfit to travel.
Limit of Liability
Prospect acknowledges responsibility for the correct description
of services offered in this brochure and for the preparation of
the travel arrangements. Only limited responsibility for the
performance of the services provided by airlines, coaches,
ferries, hotels, agents and other suppliers can be accepted by
Prospect. No responsibility is accepted for loss or expenses due
to sickness, weather, strikes, war, quarantine, customer
negligence, loss of baggage or other causes, such losses being the
responsibility of the traveller and for certain of which insurance
is available.
Cancellation by Prospect
Sometimes there has to be a minimum number of participants on a tour to make it viable, and if this is not reached we reserve the right to cancel the tour. In this case there would be a full refund of all payments made, and notification of cancellation would be at least six weeks before the departure date. If cancellation is necessitated through ‘force majeur’ - for example war, cessation of diplomatic relations, natural or nuclear disaster - we shall refund the portion of payments made to us by clients which have not been committed irrecoverably by us to the tour. However we can be under no other liability to you in such cases.
Prospect also reserves the right to cancel any booking
for which full payment has not been received ten weeks
before departure, and to levy cancellation charges.
Changes by Prospect
At the time of publication all information in our Brochures has
been checked and is, to the best of our knowledge, correct. For
reasons beyond our control changes may need to be made to the
dates of the tour, flight times, aircraft, carriers, airports, hotels,
programmes or Tour Leaders. We cannot therefore guarantee
that itineraries and programmes will be followed as published, and
reserve the right to make these changes.
Changes and extensions
All passengers using our flight arrangements must use the
outbound flight. In some cases a return flight at a later date can be
arranged, if this is requested at the time of booking. For this there
will be an administration charge of £30 per booking. Any change
or upgrade is final and must be paid for at the time of booking and
no refund can be made in any circumstance.
Connecting Travel Arrangements
Airline schedules are subject to change. We therefore strongly
recommend that any travel arrangements you make to connect
with your outbound and inbound flights are booked on a flexible
fare basis to accommodate the possibility of such alterations.
Cancellation by client
If a customer cancels a booking, the following charges will be
payable depending upon the number of days prior to
departure date:
More than 71 days before - Loss of Deposit
70 to 42 days before - 40% of Invoice
41 to 14 days before - 90% of Invoice
Less than 14 days before departure - 100% of Invoice
Cancellations are effective from the date on which written
notification is received at our office.
Price
Tours are invoiced at the price prevailing at the time of booking.
Passports and Visas for British Citizens
All countries now require a full 10 year UK Passport valid for at
least six months after the date of return.
For British Citizens resident in the UK, Prospect will obtain, help
to obtain, or advise on how to obtain a Visa when required.
Prospect cannot be held responsible if a Visa is declined.
All other Nationals, or residents of other countries, must contact
their Embassy to find out what travel documents are required, and
be responsible for obtaining them.
Complaints and Disputes
If you have a complaint, Prospect Music and Art Tours Ltd must
receive notification in writing not later than 28 days after the end of
the tour.
Airlines’ and Train Operators’ Waiver
This brochure is issued on the sole responsibility of the tour
operator. It is not issued on behalf of and does not commit the
airlines or train operators mentioned therein, or any airline or
train operator whose services are used in the course of the tours.
Single Rooms
Although supplements are payable for single accommodation, it
should be noted that single rooms have single beds and the
standard and location of these rooms is not always as good as that
of twin/double rooms.
Special Requests
Any special requests made on your booking form will be noted,
and we will do our best to provide these for you. However,
Prospect cannot guarantee to comply with your requests.
Government Tax on all Flight Departures
The Government has levied a tax on all air tickets for flights
departing from the UK as follows:
Destinations in the EC - £10 per person
Other Destinations - £20 per person
This tax is included in the Basic Price of your holiday.
Consumer Protection
The air holidays and flights in this brochure are ATOL Protected,
since we hold an Air Travel Organiser’s Licence granted by the
Civil Aviation Authority. Our ATOL number is 2719. In the
unlikely event of our insolvency, the CAA will ensure that you are
not stranded abroad and will arrange to refund any money you
have paid to us for an advance booking. For further information,

Holidays using Eurostar, EuroTunnel, Ferry or Coach are
protected by Travel Organiser’s Failure Cover (TOFC) provided
by Travel and General Insurance Company
